Terms & Conditions

These terms may be updated from time to time in the future. The Influencer agrees to review our Terms of Service  regularly by acknowledging to participate in the brand collaboration. The Influencer’s continued access to or use of  the service will mean that the Influencer agrees to the changes. The Influencer will be notified of any significant  changes to our Terms of Service.

Influencer acceptance of general terms and conditions -

  1. The created content by the Influencer has to be shared with the brand for approval and can be published  only after the same has been approved

  2. In case the brand requires any modifications in the content, the Influencer will be liable to incorporate the  same

  3. The brand will have the rights to use/promote the content created by the Influencer

  4. No comment or opinion demeaning the brand/product for the mentioned agreement and content will be  made public on any of the social channels by the Influencer before/during/after the association

  5. The association is purely based upon commercials in lieu of the services availed in this case the desired  number of deliverables by each influencer

  6. The created content by the influencer has to be shared with Zefmo for approval and can be published only  after the same has been approved

  7. The influencer would require incorporating all the feedback provided by Zefmo and/or the brand

  8. Devices issued for the review and content creation will be on returnable basis unless otherwise stated. No mention/comparison/feature of the competition brand in the campaign posts/content  

  9. No competition product/gadget to be visible in the content  

  10. If, after giving confirmation to participate in the collaboration, the influencer backs out of the activity,  he/she will be liable to pay 15% of the agreed commercials as penalty to Zefmo

  11. If the influencer is unable to complete the deliverables, monetary compensation will only be provided for  the posts which are live (posts which are not live will not be counted as a completed deliverable)

  12. If the influencer refuses to incorporate brand feedback, Zefmo stands the right to cancel the collaboration  without owing any monetary compensation to the influencer

  13. the content being published should not be demeaning to the brand or any association

  14. The influencer will be liable to make at least two edits when it comes to content (including videos) should  the brand request for the same  

  15. Indemnification

The Influencer agree to indemnify, defend and hold harmless, the Company, its affiliates, successors, and assignees,  and each of their respective investors, directors, officers, employees, agents, and suppliers (including distributors  and content licensors) from and against any losses, claims, damages, liabilities, including legal fees and expenses,  arising out of:

any claim due to or arising out of the Influencer violation of these Terms, including but not limited  to a claim arising out of a breach of the Influencer representations or warranties made hereunder;

the Influencer use or misuse of or access to our Services;

the Influencer violation of any law, regulation or third party right, including without limitation any  copyright, property, or privacy right; or

any claim that the Influencer has caused damage to a third party.

Applicable Law

These Terms of Service are governed by and constructed in accordance with Indian Law and the parties agree to submit to the  exclusive jurisdiction of the Courts of New Delhi, India.
